Property Maintenance

Basic property standards

• The structure must be maintained in a safe and sanitary manner and must provide all basic services such as electrical, heating, and plumbing services, adequate exits, floor space, ventilation, and light.
• The structure must be weather and water tight, porches and stairs must be structurally sound, and structures must be kept painted to prevent deterioration.
• The property must be free of trash, vermin, and other health hazards.
• Inoperable or partly dismantled vehicles, parts, appliances, other large salvage items or large equipment cannot be stored outside.
• No vehicle can be parked on an unimproved surface such as the lawn.
• Grass and weeds shall not be allowed to grow higher than 10 inches in height.
• All properties must have the address posted with numbers that are at least 3 inches in height, which can be clearly seen from the street for emergency services.
• Trash and garbage can be set out no earlier than 15 hours prior to the day of collection (4:00 p.m. the day before trash day). For more information on trash and recycling services, click here.

  Please note the City of Fairway may not use code violation documentation that was obtained by trespassing, entry without permission, or other illegal means.  In general, violations should be documented from public property (streets and sidewalks) or from abutting property with the permission of the abutting property owner.  Property owners have a right to privacy and photos or other documentation should never be taken through windows of the home at which the suspected violations exist nor should a homeowner's or resident's reasonable expectation of privacy be violated in any way when attempting to obtain documentation.
  
  

  Property owners are encouraged to routinely walk around their property and address the basic property standards. As you can see the top five most common violations are easily avoidable by actively maintaining the property.
  
  Common violations:

• Trash and recycling containers not properly stored out of sight.

• Grass over 10 inches in height. Weeds/volunteer growth around foundation, along fence line, or in landscaping beds.

• Brush piles.

• Vegetation growing in the gutters.

• Trees and shrubs overgrown and touching the roof line or dead limbs that should be trimmed.

• Damaged fencing and/or gates.

• Flaking/peeling paint or algae growth on house and/or accessory structures.

• Wood rot or woodpecker damage on house and/or accessory structures.

• Damaged driveway or sidewalk (tripping hazard)
  
  When a property is viewed to be in violation of Fairway Municipal Code's Basic Property Standards, the property owner is first issued a property code violation letter. The property code violation letter is not a citation! The violation letter is used to notify the property owner of the code violation and provides a time period to resolve the violation. If the property owner fails to respond to letter and resolve the violation a citation is then issued.
